    If she didn't sign one, or doesn't have it then look up the state's Landlord/Tenant Law.

    In Mass. rent is not considered "late" until it is 10 days passed due. Eviction cannot occur until you are three months behind on rent. I don't mean 3 months of consistent tardiess, but you just haven't paid rent at all in three months. And even when that happens, it will take at least 6 months for you to be physically kicked out.

    As Johnny Drama once said,

    I learned this in Landlord Tenant Law (part of the business law major).

    In my state, you have to give a 30 day eviction notice. It's different depending on the state though. Either way, this is the problem. .

    Now, the landlord has been calling, but no one has answered becuz they have nothing to give.
    Horrible mistake. Never do this. I've been in my crib for three years and only been late three times, but those times, I knew I'd be late so I went to the landlord and told exactly how late I'd be, etc. Also, every time, I put at least half the rent in his hand. If you're gong to be late, you need to make arrangements as soon as you know. You can't leave the man hanging for three weeks. Hell, that's only one week before next month's rent is due, and you haven't paid this month yet. You have to let the man know. Wtf? Lol.

    I mean, you already don't have the money. At least have the courtesy of letting the man know wtf is up. He doesn't own you, you owe him. I'm almost positive that if the day the rent was due, you went to him and let him know what was up, the water would be on and you'd have no problem. Wtf@dodging the man, when you owe.

    It's a recession. I'm sure he needs tenants and doesn't want to just kick them out. He needs money too. This is how he puts bread on the table. He's kicking them out on principle. It's not even about money.

    I can tell most of you have never been in an apartment on your own paying bills. It can tell half of you are kids. Nigga, you owe money and you're dodging the nigga you owe it to. Wtf you think is going to happen? He's not the oppressor, and he doesn't owe it to you to let you live there for free. And how would he even know you planned on paying anytime soon when you're ducking him. Wtf is up with you people's logic?

    Anyway, save the money from the paycheck to put down on a new crib. Pack up and ship out. Your family will be fine.

    Yeah...WORST thing you can do is duck someone you owe money to.

    If they WOULD and COULD have worked something out with you, they DEFINITELY WON'T now that they realize you're the type to duck and dodge your debts.

    Bad, bad mistake...

    So, yeah...if it's not too late, have them call the landlord, apologize up the ass, and try to set things right.
    If not, move the fuck out cuz you're kind of in default of the lease as well by just shutting him out and not telling the man when you'd pay him.

    Communication works!

    Trust...if you've been paying rent pretty well for several years...he's not gonna want to have to go clean the shit out of your place, repaint, recarpet...add some landscaping...all the shit he'll have to do to attract a new renter.

    He'd rather your brother-in-law just man-up and face him, tell him what's up.

    That'd be alot easier than everything he'll have to do to replace ya'll.

    I'm pretty sure Canada and US have different laws and statutes when it comes to this but he must give you fair warning before deciding to evict you. You're absolutely right that he can't do this and it's definitely not 5 days notice, the least i think it is, is 2 weeks, depending on how long they've been living there and whether its a month to month contract or annual. Your sister and her family are entitled to damages for the days you haven't had water. The only thing I can suggest is doing what you're already doing, and also try going to a local law firm for consultation or information, and check your local library and look up landlord/tenant relationship in the law section. Everything you need to know will be in that article/section. Best of luck man, don't let that fuck get away with this shit, after taking law, I've learned a lot of shit that most people let fly by cause they don't know their rights. Keep at it, you're on the right track.

    What does the lease say? Remember man, if she signed anywhere saying that this and this could happen, then shes gonna lose. He has to give you a notice. It may say somewhere where if you do not pay within the 5 days the "grace period" then the process can be started to evict. Now I don't know what yours says, but tenants have more rights than landlords, untill you break the lease agreement. Make sure you go over it well, and if not and read about your states tenant/landlord laws..if something doesnt measure up, tell him to fuck off and go to court, you will win because he didnt follow the right process, then after all that oh and by the way its 30 days you have to move, and secondly, after all that shit, id start looking for another place anyway..because its obvious that the guy is shady, or trying to outstep his boundaries.
